1-Year Limited Warranty (California)

Our One Year Limited Warranty covers all complete-pair frame and lens purchases that include Anti-Reflective lenses. The warranty begins on Day 1 and there is no cost upfront for the warranty! Should a customer break or damage their eyewear during the first year of purchase, they simply pay a $100 copayment to have the damaged part(s) replaced.

Given there is a percentage of eyewear that is delivered beyond day 1 (purchase date) we will always honor the dispensing date as the first day. The life of the limited warranty is 1 year from the dispensed date and is not available past the one year.

What Qualifies:*

         • Temples or frame chewed, marred

Exclusions:
         • Loss or theft
         • Exchanges due to a change in Rx (Rx is updated due to 'natural' change in acuity)
         • Authentics programs
         • Plano Sun purchases

Consumer Limited Warranty

COVERED PRODUCT:
LensCrafters's eyewear that contains anti-reflective coating purchased at any LensCrafters location in the State of California ("Retail Location") carry a limited warranty to the original consumer.

LIMITED WARRANTY PERIOD:
This Limited Warranty begins on the date of receipt of the Covered Product and continues for a period of one (1) year.

WHAT IS COVERED:
LensCrafters will pay the cost of labor and repair or replacement parts in the event Your Covered Product fails to operate as a result of a mechanical failure caused by defects in workmanship and/or materials, including those due to normal wear and tear. Parts will be replaced with those of like kind and quality. If the Covered Product cannot be repaired, or if the cost of the repair exceeds the original purchase price or if parts are not available due to the age of the Covered Product or discontinued by the manufacturer, the Covered Product will be replaced with a product of similar features.

WHERE YOU ARE COVERED:
Coverage under this Limited Warranty is limited to the State of California. It does not include any other States, District of Columbia, any U.S. Territories including Guam, Puerto Rico, or U.S. Virgin Islands or Canada.

WHAT IS NOT COVERED:
• INCIDENTAL OR CONSEQUENTIAL DAMAGES INCLUDING BUT NOT LIMITED TO ANY DELAY IN RENDERING SERVICE UNDER THIS LIMITED WARRANTY OR LOSS OF USE DURING THE PERIOD THAT THE PRODUCT IS AT A REPAIR CENTER OR OTHERWISE AWAITING PARTS;
• THE COST OF RETURNING THE COVERED PRODUCT TO LENSCRAFTERS;
• ANY AND ALL PRE-EXISTING CONDITIONS THAT OCCUR PRIOR TO THE EFFECTIVE DATE OF THIS LIMITED WARRANTY;
• DAMAGE FROM ABUSE, INTRODUCTION OF FOREIGN OBJECTS INTO THE PRODUCT, UNAUTHORIZED PRODUCTMODIFICATIONS OR ALTERATIONS;
• FAILURE TO FOLLOW THE MANUFACTURER'S CLEAN AND CARE INSTRUCTIONS;
• THIRD-PARTY ACTIONS (FIRE, COLLISION, VANDALISM, THEFT, ETC.);
• LOSS OR DAMAGE DUE TO THE ELEMENTS OR ACTS OF GOD;
• LOSS OR DAMAGE DUE TO WAR, INVASION OR ACT OF FOREIGN ENEMY, HOSTILITIES, CIVIL WAR, REBELLION, RIOT, STRIKE, LABOR DISTURBANCE, LOCKOUT OR CIVIL COMMOTION;
• DAMAGE COVERED BY ANY OTHER WARRANTY OR SERVICE CONTRACT;
• PRODUCTS NOT ORIGINALLY COVERED BY A MANUFACTURER 'S WARRANTY OR RETAILER'S STORE RETURN POLICY;
• PREVENTATIVE MAINTENANCE;
• DAMAGE WHICH IS NOT REPORTED WITHIN THIRTY (30) DAYS AFTER EXPIRATION OF THIS LIMITED WARRANTY;
• ANY LOSS OTHER THAN A COVERED BREAKDOWN OF THE PRODUCT;
• DECORATIVE EMBELLISHMENTS AND /OR ACCESSORIES ATTACHED TO THE PRODUCT;
• DAMAGE CAUSED BY ANIMALS AND INSECTS; UNAUTHORIZED REPAIRS;
• PURCHASE OF A COVERED PRODUCT THAT OCURS OUTSIDE OF THE STATE OF CALIFORNIA;
• DAMAGE INCURRED DURING TRANS PORTATION;
• DAMAGE FROM TAMPERING WITH ELEMENTS DESIGNED TO SECURE LENSES AND OR ARMS, OR UNAUTHORIZED PRODUCT MODIFICATIONS OR ALTERATIONS; PRODUCTS THAT ARE LOST OR STOLEN;
• EYE EXAMS OR OTHER MEDICAL EXPENSES ASSOCIATED WITH OBTAINING REPLACEMENT EYEWEAR;
• CLEANINGS, ADJUSTMENTS, AND FITTINGS; AND
• REPAIR OR REPLACEMENT OF EYEWEAR DUE TO A COSMETIC CHANGE, OUTGROWTH OF EYEWEAR, A CHANGE IN OPTICAL PRESCRIPTION OR ANY OTHER MEDICAL REASON.

What to do when Your Product fails to Operate:
Should the Covered Product fail to operate, return the Covered Product to any LensCrafters retail location.

Service DEDUCTIBLE:
There is a $100.00 deductible required to obtain service for your Covered Product.

OTHER PROVISIONS:

Limit of Liability:
The limit of liability under this Limited Warranty is the least of the cost of (1) the purchase price of the Covered Product excluding tax and delivery costs or (2) authorized repairs not to exceed the purchase price of the Covered Product or (3) replacement of the Covered Product with similar features or (4) reimbursement for authorized repairs or replacement. Upon replacement, there is no longer any obligation for the replaced product under this Limited Warranty.

Limitations of Implied Warranty:
All Implied Warranties which may arise under state (California) law, including all Implied Warranties of Merchantability or Fitness for a particular purpose, are limited to the duration of this Limited Warranty and do not cover incidental or consequential damages. Some states (only applies to California) do not allow limitations on how long an Implied Warranty lasts or the exclusion of incidental or consequential damages, so the above limitations or exclusions may not apply to You. This Warranty gives You specific legal rights, and You may also have other rights which vary from state to state (this only applies to California).

Transferability and Renewals:
This Limited Warranty is not transferable or renewable.

Subrogation:
If LensCrafters pays loss, it may require you to assign LensCrafters your rights of recovery against others. LensCrafters will not pay for a loss if you impair these rights to recover. Your rights to recover from others may not be waived.

Governing Law, Dispute Resolution and Arbitration:
This Limited Warranty shall be governed by the laws of the State of California without giving effect to any conflict of laws principles that may provide the application of the law of another jurisdiction, provided, however, that this dispute resolution agreement is governed by the Federal Arbitration Act.

Any claim or dispute in connection with this Limited Warranty shall be resolved through binding non-appearance-based arbitration («Arbitration») Any Arbitration under this Limited Warranty will take place on an individual basis; class arbitrations and class actions are not permitted. You and LensCrafters agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

Before commencing any arbitration proceeding under this Limited Warranty, you should present your claim or dispute to LensCrafters by calling 1-877-7LENSCRAFTERS (1-877-753-6727), and allowing LensCrafters the opportunity to consider resolving the claim or dispute. If your claim or dispute is not resolved to your satisfaction, you may commence arbitration proceedings in accordance with the provisions of this Limited Warranty.

The Arbitration shall be initiated through an established alternative dispute resolution provider mutually agreed upon by the parties. If the parties cannot agree on a dispute resolution provider, the American Arbitration Association will administer the arbitration process. The alternative dispute resolution provider and the parties must comply with the following rules:
a) the Arbitration shall be conducted by telephone, online and/or be solely based on written submissions, the specific manner shall be chosen by the party initiating the Arbitration; b) the Arbitration shall not involve any personal appearance by the parties or witnesses unless otherwise mutually agreed by the parties; and c) any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.

Alternatively, and notwithstanding the foregoing, either party may elect to bring an individual action against the other in small claims court if the amount claimed is within the jurisdiction of such court. In that event, you agree that the parties are each waiving the right to participate in a class action.

In the event that one or more of these provisions shall, for any reason, be held to be unenforceable, the remaining provisions will remain in full force and effect.
